Tamil Nadu Voters : A Dash for Cash?


      Tamils are criticized again, for a familiar reason in a familiar season.  It was the feverish run-up to the 2016 State assembly polls held early this week in Tamil Nadu.  And it was the widespread distribution of cash to voters, credited to two major political forces, to buy votes in advance of the polls. So Tamils are blamed for unashamedly selling their solemn democratic rights for cash.  But they may have our sympathies, though surely not support.

Legally you cannot show that Tamil Nadu's two leading political parties, DMK and ADMK, arranged delivery of cash to large sections of voters during the last assembly polls, though these parties may stand accused.  When cash for votes was flowing in torrents, how did the two parties react? Each of them just blamed the other as the culprit. But both of them never appealed to the public to refuse cash for votes whoever might be offering!

     You know, many elected representatives and many government servants in India pocket cash for doing their official duty or for showing illegal favours in return. How is it different from the general public accepting cash and promising to vote for a political party? You know that too. People’s representatives and government servants given to corrupt ways demand, through clear words or signals, illegal money from the public or from businessmen for normally doing routine things or for specially taking wrong decisions. Here the prime mover is the receiver.  In cash for votes, the prime mover is the giver.  This evil debuted in Tamil Nadu during a bye-election to Thirumangalam assembly constituency in 2009 when a political party extensively introduced the technique of offering cash to voters to bag their votes.  From then on this election strategy acquired a scientific name, as “Thirumangalam Formula”.

      Was it entirely upto the Tamil Nadu voters to refuse any cash offered and turn away all bribe-givers, so that if none was prepared to receive no political party would be willing to pay? In cold theory, yes.  But look at a few connected things. 

       A bribing political party of Tamil Nadu chooses its preys well and they are in large numbers.  A briber will not knock at the door of a palatial house or other decent houses whose inmates are somewhat well off and who don’t look like putting out their hands to cash for votes.  Those who receive it, whether it is Rs.200, Rs.500 or more, are people to whom that money means quite a bit in their lives, but they are not stealing.  The target voters sense, consciously or subconsciously, that cash for votes comes from those who have amassed wealth in dubious ways, even as the poor voters are struggling.  So voters will feel it is not wrong to receive that money, or even to ask for a little more.  This phenomenon is similar to tax payers concealing their incomes when the income tax rates are unfairly high, but complying with tax laws voluntarily when the tax rates are reasonable.  Different expropriations produce different responses.

Corruption levels are high in Tamil Nadu.  Many say it could be the topper among all States on the corruption index.  Ordinary people of the State cannot fight that curse.  Receiving cash for votes, from those connected to the corrupt, is a petty solace and justification they may have in their financial status.  When the government doesn’t play democracy to its people, in the form of a clean administration at the minimum, don’t expect the people to play democracy in perfect ways.  But generally the Tamil population are a good lot, and I guess they would even feel bad to say it out that they are justified in doing an apparently shameful act.  They are generally honest too.  I know of many house maids in Tamil Nadu who will take cash offered during election time, but would not touch a ten-rupee note lying anywhere in the homes they work even if nobody is looking.

India is not a mature democracy yet, but is getting better over time.  Its judiciary has been more active in recent years, granting reliefs in public interest cases and checking executive excesses.  Its Central Election Commission does a good job, far better than earlier times, conducting free and fair elections to Parliament and State Legislatures.  Its newspapers and television channels are generally independent, though some of them could be more responsible. People have shown they could pack off a non-performing central government when they unseated the long-entrenched Congress Party in the last Parliamentary elections.  But one body in the country which has gone from good to bad and to worse is its political class and the government they provide, especially in the States.  

      The top brass of the Indian political class and its governments across India operate in stealth and seclusion, and it is hard to correct their ways.  It is the political class which is the receiver of bribes at government level (government servants follow them) and the payer of bribes to voters at election time.  When villainous politicians do not change, or cannot be made to change in a largely uninformed society, blaming the givers in government transactions or receivers at election time is barking up the wrong tree.   For now, our trust and hope can only be on the people and their inherent goodness to bring pressures for change on the politicians.  Yes, it will take time.

Back to the present day. A government official receiving bribes differs from a voter receiving cash in another crucial way.  The person who bribes a government official gets things done for the deal-money paid.  In cash for votes, the bribe giver cannot know if the voter promising to vote for someone really voted for that person or for another candidate of the voter’s choice.  Also, the voter may have already decided to vote for a political party, and do it exactly.  But before polling he may still take cash from that party’s agent giving a promise to vote as directed, and from the agent of the rival party too giving a different promise.  Here the voter does not ‘sell’ his vote. 

I guess that most of Tamil Nadu voters in the 2016 elections have not sold their votes.  And I guess that when they decided to grab the cash, there was a feeble murmur in their inner hearts, “Let the incorrigible rascals cough up a drop of their bad money”.  Make your guess.

காதணி, காலணி, கூட்டணி


விஜயகாந்த், தி.மு.க.வோடு அணி சேராமல் மக்கள் நலக் கூட்டணியில் இணைவார் என்று பலர் நினைத்திருக்க மாட்டார்கள்.  ஜி.கே.வாசன் தலைமையிலான தமிழ் மாநில காங்கிரஸும் அ.தி.மு.க. கூட்டணியில் இடம் பெறாமல் மக்கள் நலக் கூட்டணியைப் பற்றிக் கொள்ளும் என்றும் அனேகர் எதிர்பார்திருக்க மாட்டார்கள். விஜயகாந்தும் வாசனும்கூட அவர்களின் கூட்டணி முடிவைக் கடைசிவரை எண்ணியிருக்க மாட்டார்களோ என்னவோ!

ஒரே சமயத்தில் தி.மு.க., பா.ஜ.க., மக்கள் நலக் கூட்டணி கட்சிகளுடன் தே.மு.தி.க. பல நாட்கள் பேச்சுவார்த்தையும் பேரமும் மேற்கொண்டு அந்தக் கட்சிகளைப் பெரும் எதிர்பார்ப்பில் வைத்துப் பின்னர் அவைகள் அனைத்தையும் அம்போ என்று நன்றி கூறிக் கைவிட்டது - பிறகு அதிலிருந்தும் பின்வாங்கி மக்கள் நலக் கூட்டணியில் ஐந்தாவது கட்சியாக இணைந்தது - விஜயகாந்தின் குயுக்தி அல்லது முதிர்ச்சியின்மை என்கிற விமரிசனமும் வந்தது.

பல அரசியல் கட்சிகள் தமக்கு விழும் ஓட்டுகளை அதிகப்படுத்தவும் சட்டசபையில் கூட்டாக மெஜாரிடியை எட்டுவதற்கும் தமக்குள் ஏற்படுத்திக்கொள்ளும் தொகுதி உடன்பாடுதான் தேர்தல் கூட்டணி.  சேர்ந்தால், சேரும் எல்லாக் கட்சிகளுக்கும் ஆதாயம், தனியாகப் போட்டியிட்டால் அவை அனைத்திற்கும் பலம் குறைந்து ஓட்டிழப்பு ஏற்படும் என்பதால் தேர்தல் கூட்டணிகள் அமைகின்றன.  இந்தத் தேர்தல் கணக்குகள் சாதாரண கூட்டல் கழித்தல் ரகம்தான்.  இவை கட்சிகளுக்குத் தெரிந்தாலும் பெருவாரியான அப்பாவி இந்திய மக்களுக்குப் புரிபடாமல் அவர்கள் தேர்தலையே சர்க்கஸ் மாதிரி பார்க்கிறார்கள். மக்களைப் புரிந்துகொண்ட அரசியல் கட்சிகளும் தலைவர்களும் அப்போது அந்தர் பல்டிகள், ஆகாசத் தாவல்கள் என்று வகை வகையான காட்சிகள் தருகிறார்கள். தேர்தல் வாக்குறுதிகளில் கோமாளி்த்தனங்கள் காட்டி மக்களை மயக்கி மகிழ்விப்பதும் உண்டு. இவை அனைத்தும் தமிழக சட்டசபைத் தேர்தல்களுக்காக அமர்க்களமாக அரங்கேறிக் கொண்டிருக்கின்றன.

குடியுரிமை பெற்று 25 வயது கடந்த யார் வேண்டுமானாலும் சட்டசபைத் தேர்தலில் போட்டியிட்டு வெல்லலாம். பின்னர் மெஜாரிடி உறுப்பினர்களின் ஆதரவுடன் ஒருவர் மாநில ஆட்சிக்கு முதல் அமைச்சராகத் தலைமை ஏற்கலாம். இந்த சட்டம் மக்களின் ஜனநாயக விருப்பத்திற்கும்  உரிமைக்கும் தரப்படும் அங்கீகாரம்.  அதன் தொடர்ச்சியாக வருவது தேர்தலில் போட்டியிடுவோரின் சுதந்திரம். அதாவது சுயேச்சையாகவோ ஒரு கட்சியின் பிரதிநிதியாகவோ ஒருவர் எந்தத் தொகுதியிலும் நிற்கலாம். தேர்தல் முடிவுகள் எந்தக் கட்சிக்கும் அல்லது கூட்டணிக்கும் மெஜாரிடி தரவில்லை என்றால் ஜெயித்த உறுப்பினர்கள் கொண்ட கட்சிகள் திடீர்க் கூட்டணி அமைத்து மெஜாரிடி ஏற்படுத்தி ஆட்சியைப் பிடிக்கலாம்.

ஆட்சிக்காகத்தான் தேர்தல். வெல்பவர்களுக்குத்தான் ஆட்சி. எவர் வேண்டுமானாலும் வெல்லலாம்.  ஆகையால் எந்த ஒரு கூட்டணியும் எந்தக் கட்சிகளைக் கொண்டும் அமையலாம். மூன்று கட்சி அமைப்புகளோடு ஒரே நேரத்தில் விஜயகாந்தின் தே.மு.தி.க. கூட்டணிப் பேச்சுவார்த்தையில் ஈடுபட்டது சரியல்ல என்றால் அந்த மூன்றும் ஒரே சமயத்தில் தே.மு.தி.க.வுடன் பேசியபடி விஜயகாந்தைத் தன் பக்கம் இழுத்து மற்ற இரண்டையும் பலவீனமாக்க முயற்சித்ததும் சரியாகாதே?  அவருடன் கைகோர்க்க முயன்ற பிற கட்சித் தலைவர்கள் கூட்டணி பேரக் கில்லாடிகள். ஒரே நேரத்தில் அவர்களிடம் கூட்டணிக்காக தே.மு.தி.க. தொடர்பு கொண்டது அக்கட்சி சில பாடங்கள் பயிலவும் அதன் நிபந்தனைகளைப் பெரிதும் தளர்த்தாமல் வைத்துக் கொள்ளவும் உதவி செய்திருக்கும். 

பெண்களின் காதணி நாளுக்கொரு விதமாக மாறலாம்.  எவரும் உடைக்கேற்றபடி  காலணியையும் அவ்வப்போது மாற்றலாம். அதுபோலத்தான் தேர்தல் கூட்டணியும்! தேவைக்கு ஏற்றபடி கட்சிகள் எப்படி வெண்டுமானாலும் சேர்ந்து கொள்ளலாம், கூட்டணியை மாற்றி மாற்றியும் வைத்துக் கொள்ளலாம் என்று எல்லாக் கட்சிகளும் பழகிவிட்டன. இருந்தாலும், கூட்டணி முயற்சிகளில் விஜயகாந்த் ஒரு ஏல வியாபாரியைப் போல் அதிக பட்ச ஆதாயம்தான் தனது ஒரே குறிக்கோள் என்கிற தோற்றத்தைக் கொடுத்துவிட்டார். இது ஒரு குறை. அரசியல் தலைவர் எவருக்கும் அவரது செயலும் முக்கியம், அவர் தரும் தோற்றமும் முக்கியம் என்பதை விஜயகாந்த் உணரவேண்டும்.

சுதந்திரமாக வாக்களிக்கும் மக்கள், சுதந்திரமாகப் போட்டியிடும் கட்சிகள் மற்றும் வேட்பாளர்கள் ஜனநாயகத்தின் முக்கிய அடையாளங்கள். மக்கள் அனைவரையும் ஓட்டுப்போட அனுமதித்து, ஆனால் போட்டியிட நினைக்கும் நபர்களுக்கு சுதந்திர வாய்ப்புக் கொடுக்காமல் ஒப்புக்கு பொம்மைத் தேர்தல் நடத்தும் நாடுகள் உண்டு. இந்தியாவில் மத்திய தேர்தல் கமிஷன் நடத்தும் தேர்தல்களில் பொதுவாக வாக்காளர்களுக்கும் வேட்பாளர்களுக்கும் உள்ள சுதந்திரம் ஜனநாயகத்திற்குப் பெருமை சேர்ப்பதாகும்.  ஆனால் கிடைத்த சுதந்திரத்தைத் தெளிவுடனும் பொறுப்புடனும் அனுபவித்து நமது வாக்காளர்களும் வேட்பாளர்களும் ஜனநாயகத்துக்குப் பெருமை சேர்க்கும் காலம்தான் வெகு தூரத்தில் உள்ளது.

Bharat Mata ki Jai – or Bye?


       Lok Sabha member Asaduddin Owaisi of AIMIM has triggered a debate on saying aloud “Bharat Mata ki Jai” (glory to Mother India).  He said the Constitution did not compel anyone to utter those words and he would not chant them. But none of us look for Constitutional compulsions in every single thing we consider right, good or necessary to do.  For instance, if we need to say, the Constitution does not command us to breathe, vote or contest an election.   Let us then look at a few other things.

We all know. There is no god in Hindu religion with the name 'Bharat Mata'.  So it is nothing about a god projected by a religion and recommended to people of other religions. Bharat Mata is just a mental personification of an India held dear in our hearts.  The people, as well as the Constitution, of the country recognise ‘Bharat’ as denoting India. So we get the term Bharat Mata, as a manner of speaking. It is a fine evocative expression too.  Only dull heads with no idea of the beauty or effect of imagery will ask, "How can a country be a mother?"

‘Bharat Mata' is not the only expression people use to cherish their nation, its leaders or its values. Another term heard all over the world is 'father of the nation'.  No one in India objects to Mahatma Gandhi being hailed as the father of our nation.  A political leader who plays a pivotal role in the founding of a nation or in liberating it may be affectionately called by its people as the father of their nation. By tradition, a father protects, nurtures and leads his children to adulthood who then look up to him with respect and gratitude - both of which happened more in earlier times.  Likewise, a leader who devotes his energy and acumen in the evolution of a nation is acclaimed as a father of the nation. In Indian culture a mother is specially loved and respected by her children - yes, more in earlier times - for all her physical sacrifices in giving birth to them and caring for them during their infancy and growing years, with many sleepless nights, and for the lasting emotional bond that she, more than the father, builds with them.  So if you wish to portray a grateful reverence to your nation that is Bharat, no wonder you would call her Bharat Mata.

English people too have associated ‘mother’ with one's country. So they have the word 'motherland'.  For Indians, hailing their nation Bharat Mata is like other nationalities calling their nation motherland. Uttering or hearing the words ‘Bharat Mata’ should evoke in Indians a bonding with the land of their birth, which does not happen with the mere name of India or Bharat or Hindustan, certainly not as deeply. Don't you see the difference between a resounding chant of "Bharat Mata ki Jai" and a lifeless shout of "Hindustan Zindabad"?

Some leaders contend that the slogans "Bharat Mata ki Jai" and "Hindustan Zindabad" mean the same thing and so it is all right if they refuse to utter the former and just say the other. This is a poor robotic argument. What would you say to someone who asserts that gulping a spoonful of plain sugar and relishing a piece of halwa are just the same thing? Tasteless.

Not just a leader, but a country's cherished value too is personified. A shining example of this is New York's Statue of Liberty. It is not a statue for Liberty. It is the Statue of Liberty.  US citizens do not protest the idea of depicting inanimate liberty in the form of a lady.

       Well-publicised news reports quote a noted Indian historian, also a Marxist, as saying, “Bharat Mata has nothing to do with India’s ancient or medieval past.  It is a European import.  Notions of motherland and fatherland were talked about in Europe.” Here is an unstated suggestion that if Indians give up the chanting of ‘Bharat Mata ki Jai’ they would be in tune with their hoary past and would be rid of a present-day controversy.  Even if the historian is right on facts, it is surprising he is so mechanical about the issue and unmindful of positive popular sentiments.  For that matter, Constitutional government has also nothing to do with India’s ancient or medieval past and is a European import, but that is not to be mentioned today disapprovingly in any context.  And then, Marxism propagated in India is also of foreign import, but that cannot be a reason to disagree with that philosophy. If a practice or activity is legally permissible in our public life and is preferred by many but opposed by some, the right question to ask first is if that works to the public good.  Ordinary Indians are emotionally driven, and so a good slogan for the nation with a unifying emotional content is welcome.
           
        It is not that Indian Muslims as a whole object to the chanting of ‘Bharat Mata ki Jai’, which is what Owaisi wants us to believe.  But he is an Indian leader and ordinary people have to fear him, unlike in mature democracies where leaders fear misreading people's minds. Poet and lyricist Javed Akhtar won the hearts of many Indians when he spoke recently in the Rajya Sabha, denouncing Owaisi’s statement and himself chanting ‘Bharat Mata ki Jai’.  This is not to say that Javed Akhtar has given in.  He has recognized the value of that chant for all Indians, and so has gone with it for the good of his nation. But he is not in active politics, and Owaisi is.  Imagine the shot in the arm for Hindu-Muslim brotherhood if Owaisi could say, “For Hindus and Muslims in India, standing together for the glory of India and saying ‘Bharat Mata ki Jai’ is a strong message to ourselves and to the world. It helps us all to march forward and grow”.   

Owaisi is not alone in the art of political maneuvering.  Many other politicians too play it best from their positions.  He is one among several short-sighted leaders from most Indian political parties who have abysmally failed a great nation.  Bharat Mata has a hard journey ahead though many may cheer her.

உங்கள நம்பி கடன் குடுத்த பாங்குக் காரா 9000 கோடி ரூபா போச்சேன்னு கையைப் பிசைஞ்சிண்டிருக்கா.  நீங்களோ இங்கிலாண்ட் மாளிகைல ஹாய்யா ரெஸ்ட் எடுத்திண்டிருக்கேள்.  ஒரு நாட்டுல தொழில் பண்ணி பெருசா நஷ்டப்பட்டாலும் தப்பிச்சு வாழறதுக்கு இன்னொரு நாட்டுல ஜரூரா ஏற்பாடு பண்ணிக்கணும்னு  தப்பு தொழிலதிபர்களுக்கு ப்ராக்டிகலா காட்டிருக்கேள். உங்க கம்பெனி திவாலானத விட இது ரொம்பக் கேடு பண்ற உதாரணம்னு எனக்குத் தோண்றது. 

கடன் குடுக்கறவா நீர்மோர் மாதிரி அள்ளி அள்ளிக் குடுத்தா வாங்கிக்கறவா சாப்டுட்டு ஏப்பம்தான் விடுவா.  இதயே நீங்க வேற வார்த்தைல சொல்லி 9000 கோடி நஷ்டத்துக்கு நீங்க பொறுப்பில்லன்னு பேசிருக்கேள்.  “கடன்ல தவர்றது வியாபார விஷயம்.  எல்லா ரிஸ்கும் தெரிஞ்சுதான பாங்க் கடன் குடுத்தது? கடன் குடுக்கறதப் பத்தி நாங்க ஒண்ணும் முடிவு பண்றதில்ல. அவங்கதான் அந்த முடிவை எடுக்கறாங்க” அப்படின்னு விளக்கம் சொல்லிருக்கேள்.  உங்க கெட்டிக்கார வியாக்கியானத்துக்குள்ள ஒண்ணு ரண்டு சோக விஷயமும் இருக்கு.

”வாங்கின கடனை அடைக்கலயே, பாங்குகளுக்கு எவ்வளவு பெரிய நஷ்டம்?  இது தேசத்துக்கும் நஷ்டமாச்சே”ன்னு துளிக்கூட வருத்தம் உங்களுக்கு இல்லை. ஒரு வேளை, வருத்தப் படறா மாதிரி பேசினா நம்ம பேர்லயும் தப்பு இருக்குன்னு ஆயிடுமேன்னு நினைச்சு ‘பாங்க் நஷ்டத்துக்கு பாங்க்தான் காரணம்’னு சொல்லி பாசாங்கு பண்றேளான்னும் தெரியலை. ஆனா ஒண்ணு – இவ்வளவு பெரிய கடன் பாக்கி நிக்கறதுக்கு பாதிக் காரணம் வாரிக் குடுத்த பாங்குகள்ங்கறதுல சந்தேகம் இல்லை. அவா உங்களுக்கு இன்னும் குடுத்திருந்தாலும் வேண்டாம்னா சொல்லிருப்பேள்? நீங்க அதையும் வாங்கிண்டு நஷ்டத்தை 18000 கோடிக்குக் கொண்டு வந்திருப்பேள். அப்பயும் பாங்க் பட்ட நஷ்டத்துக்கு பாங்க் காரணமே இல்லைன்னா சொல்றது? இப்ப ஏற்பட்ட நஷ்டத்துக்கு பாங்கும் உண்டான பொறுப்பை ஏத்துக்கணும். அதோட உங்க கம்பெனிக்காக பாங்க்க யாராவது ஆட்டி வச்சிருந்தா அவாளுக்கும் பொறுப்பு உண்டு. ஆனா சட்டப் படியோ தார்மிகப்படியோ உங்க பொறுப்பு குறையவே குறையாது.

’நீங்க வேற, உங்க கம்பெனி வேற. கடன் வாங்கினது நீங்க இல்லை, உங்க கம்பெனிதான்’கற சட்ட விஷயம்லாம் இருக்கட்டும். நீங்க கிங் ஃபிஷர் ஏர்லைன்ஸ் கம்பெனி தலைமைல இல்லேன்னா பாங்குகள் இந்த அளவுக்கு அதுக்குக் கடன் குடுத்து நஷ்டப் பட்டிருக்காது. மல்யா மாதிரி ஒரு கைகாரர் கேட்டாத்தான் அவாளும்  யோசிக்காம மலையளவுக்கு கடன் குடுப்பா. இல்லேன்னா இதே மாதிரி நிறைய பேருக்கு நிறையக் குடுத்து பாங்குகளே திவால் ஆயிருக்கணுமே?

கடன் உங்க கம்பெனி வாங்கினாலும் உங்க மவுசுலதான் அது நடந்தது. உங்க மவுசு ரொம்பப் பெரிசுன்னு முன்னாள் பிரதம மந்திரி ஒருத்தர் இருக்காரே, தேவ கவுடா மாமா, அவருக்கு நன்னாத் தெரியும்.  9000 கோடி பாக்கிக்கு உங்க மேல பாங்க் நடவடிக்கை வரப்போறதுன்னு நியூஸ் வந்த உடனே மனுஷர் போட்டார் ஒரு போடு.  “கடன் வாங்கித் திருப்பித் தாராம மத்தவங்க இருக்கும்போது மல்யாமேல மட்டும் எதுக்கு நடவடிக்கை?”ன்னு கேட்டிருக்கார். அதாவது, “நடவடிக்கை எடுத்தா எல்லாக் கடனாளிகள் மேலயும் ஒரே நாள்ள எடுங்கோ. ஒவ்வொருத்தரா ஆரமிச்சா மத்தவா  மேல முடிச்சுட்டு கடைசியா மல்யா கிட்ட வாங்கோ”ன்னு சொல்ல வரார்.  பிரதம மந்திரியா இருந்த ஒருத்தர் “மல்யா மேலயும் சம்பத்தப் பட்டவா மேலயும் கடன் பாக்கி தொடர்பா எல்லா நடவடிக்கையும் எடுக்கணும். அதோட, பெரிய அளவுல பாங்க் கடன் வாங்கி அடைக்காத மத்தவா மேலயும் வசூல் நடவடிக்கை வரணும்”னு பேசினா நன்னா இருக்கும்.  அதை விட்டுட்டு உங்கள தாங்கிப் பிடிக்கறா மாதிரியே பேசறாரே! நீங்களும் சரி அவரும் சரி, ஏதோ 'கொடுத்து வச்சவா'ளாத்தான் இருக்கணும்.

அரசியல்னா பதவி முக்கியம். தொழில்னா லாபம் முக்கியம். அதெல்லாம் மாத்த முடியாது.  ஆனா அரசியல் வழிமுறைகளையும் தொழில் நடத்தைகளையும் சட்டமும் தார்மிகமும் சேர்ந்து சரியா கட்டுப் படுத்தலைன்னா பதவி ஆசையும் லாபக் கணக்கும் நாசத்தைக் கொண்டு வரும்.  உங்க விஷயத்துல அதான் நடந்திருக்கு. இதுல தார்மிகம் விழுந்திருக்கு. சட்டம் எழுந்து நிக்கறதான்னு பாக்கணும்.

கன்னையா, என்னையா சொல்றீங்க?


நாங்கள் கேட்டது ”இந்தியாவிலிருந்து அல்ல, இந்தியாவிற்குள் சுதந்திரம்” என்று புதிய விளக்கம் சொல்லி கோஷம் எழுப்பி இருக்கிறார் ஜவஹர்லால் நேரு பல்கலைக் கழகத்தின் (ஜே.என்.யூ-வின்) மாணவர் தலைவர் கன்னையா குமார். தேசதுரோக வழக்கில் கைதாகி பிறகு டெல்லி உயர்நீதி மன்றத்தில் பெயில் வாங்கி வெளியில் வந்து அவர் பேசியது இது.   உள்நாட்டு சுதந்திரம் மறுக்கப்படும் நாடானால் அங்கிருந்து இது போன்ற கூக்குரலை ஒருவர் வெளியிட்டிருக்க முடியாது.  அது டெலிவிஷன், செய்தித்தாள்கள் மூலமாக பின்னர் மேலும் பரவியும் இருக்காது. 

அடிப்படை ஜனநாயக சுதந்திரம் ஒரு நாட்டில் இல்லை என்றால் அதற்கான அடையாளங்கள் நன்றாகத் தெரியும்.  அங்கு தேர்தல்கள் பாரபட்சமின்றி நடக்காது. மேலும் அது போன்ற நாட்டில் ஆளும் கட்சியைத் தலைநகரிலேயே தீர்க்கமாக தேர்தலில் வென்று அரவிந்த் கேஜ்ரிவால் போல் முதல் அமைச்சராக முடியாது. அல்லது நாட்டிலேயே அதிகமான அரசியல் அதிகாரங்கள் கொண்ட பிரதம மந்திரியை கன்னையா மாதிரி சவால் விட்டு எக்காளமாக விமரிசிக்க முடியாது. மற்றொரு அடையாளம், ஆட்சியைப் பற்றி குடிமக்கள் துணிவாக விமரிசித்தால் அவர்கள் தொடர்ந்து சுதந்திரமாகவும் பாதுகாப்பாகவும் இருக்க மாட்டார்கள்.  சீனா, பாகிஸ்தான், ஈராக், கியூபா, சிங்கப்பூர் ஆகிய சில நாடுகளில் இந்த அடையாளங்கள் சிரிதும் பெரிதுமாக உண்டு. இது போன்ற வேறு பல நாடுகளும் உள்ளன. இந்த நாடுகளில் தேசதுரோக வழக்கில் ஒருவர் கைதானால் கோர்ட்டு மூலம் பெயில் கிடைப்பது மிக அரிது.  பெயில் கிடைத்து விட்டாலும் வெளியே வந்துவிட்டு “இந்த நாட்டுக்குள் சுதந்திரம் வேண்டும்” என்று கூட்டமாக நின்று கோஷம் போட்டால் பிறகு அவரைத் தேட வேண்டும். இந்தியாவில் தனி மனித உரிமைகளுக்கு – அதுவும் அரசை எதிர்க்கும் சுதந்திரத்திற்கு – இப்படிக் குறைகள் இல்லை.

நமது நாட்டில் சுதந்திரத்தைப் பற்றிக் குறை உண்டென்றால் அது கட்டுப்பாடில்லாமல் கிடைக்கிறது என்பதுதான் – அதாவது முறையான அரசுக் கட்டுப்பாடோ அல்லது பொறுப்பான சுய கட்டுப்பாடோ இங்கு இல்லை. இவற்றிற்கு வலுவான ஒரு சாட்சி - இந்தியாவில் பல நாசவேலைகள் செய்த தீவிரவாதிகளும் அவர்களுக்குக் கிடைத்து வரும் அரசியல் தலைவர்களின் ஆதரவும்.

கன்னையா குமார் என்ன சொல்ல வருகிறார்? எதிர்க் கட்சித் தலைவர்களான சோனியா காந்தி, ராகுல் காந்தி, அரவிந்த் கேஜ்ரிவால், லாலு பிரசாத், நிதிஷ் குமார், முலயாம் சிங் யாதவ், மாயாவதி போன்றவர்களுக்கெல்லாம் சுதந்திரத்தை அனுமதித்து விட்டு, ஒரு சில மாணவர்களை மட்டும் மத்திய அரசு கட்டுப் படுத்துகிறது என்கிறாரா?  அப்படி என்றால் அந்தத் தலைவர்களுக்கு நிகரான, அல்லது அவர்களுக்கும் இல்லாத, அரசியல் சக்தி இந்த சாதாரண மாணவர்களிடம் உள்ளதாமா?  ஆம் என்றால் அவர்கள் பல்கலையை விட்டு வெளியே வந்து தீவிர அரசியலில் ஈடுபட்டு இன்னும் பெரிதாக வளர முயற்சிக்கலாம்.  ஆம் என்றாலும் இல்லை என்றாலும் பல்கலைக் கழகத்தை விட்டு இந்த மாணவர்கள் வெளியேற வேண்டும்.  ஏனெனில் படிப்பில் ஈடுபட்டு அதற்குண்டான அறிவை வளர்த்துக் கொள்பவர்களுக்கான இடம் அது மட்டுமே.  அந்த ஆர்வம் கொண்டவர்கள் வேறு இடத்தில் அதைப் பூர்த்தி செய்ய முடியாது.  படிப்பில் முழுக் கவனம் செலுத்த வேண்டிய வருடங்களில் மாணவர்கள் தீவிரமாக வேறு வேலைகளிலும் – முக்கியமாக அரசியலில் – இறங்கி நேரத்தை விரயம் செய்யக் கூடாது. இளைஞர்களின் முன்னேற்றத்திற்கும் நாட்டின் வளர்சிக்கும் அமைதியாக படிப்பு விஷயங்களில் மட்டும் இயங்கும் பல்கலைக் கழகங்கள் தேவை. ஆளும் கட்சியையும் பிரதம மந்திரியையும் – அது எந்தக் கட்சியோ அவர் எந்த நபரோ - எதிர்த்தோ அல்லது வேறு வகையில் அரசியல் செய்ய விரும்பினால் அதற்கான இடம் வெளி இடம். அந்தப் பெரிய வெளி இடம் கன்னையா குமாருக்கும் அவர் போன்ற ஆர்வம் கொண்ட சக மாணவர்களுக்கும் டெல்லியிலும் இந்தியாவெங்கும் உண்டு.

சிறப்பான ஐ.ஐ.எம், ஐ.ஐ.டி போன்ற கல்விக் கூட வளாகங்களில் ஜே.என்.யு-வில் காண்பது போல் மாணவர்களிடையே அரசியல் நாட்டமும் உத்வேகமும் இல்லை. அந்த மாணவர்கள் படிப்பில் மட்டும் குறியாக இருந்து தானும் வளர்ந்து தங்கள் கல்வி நிலையங்களுக்கும் பெருமை சேர்க்கிறார்கள். படிப்பில் முழுக் கவனம் வைத்திருப்பதை விட மாணவர்களுக்கு வேறு முக்கிய வேலை கிடையது. ஆனால் ஜே.என்.யு மாணவர்கள் பத்திரிகைகளாலும் டி.வி-க்களாலும் பேசப்படுவது அம் மாணவர்களின் கல்விச் சிறப்பால் அல்ல. இது ஜே.என்.யு-விற்கு எற்பட்டிருக்கும் நிர்கதி.

இன்னொரு விஷயம். தாங்கள் கோரிய விடுதலையானது பசி, ஏழ்மை, ஊழல், ஜாதிப் பிரச்சினை ஆகியவற்றிலிருந்து மீள்வதற்கான விடுதலைதான் என்று இப்போது மேலும் விளக்குகிறார் கன்னையா. ஆனால் நடந்து முடிந்த நிகழ்சிகள் என்ன காட்டுகின்றன? சென்ற பிப்ரவரி 9-ம் தேதி ஜே.என்.யு வளாகத்தில் நடந்த அஃப்சல் குரு ஆதரவுக் கூட்டத்தின் பின்னணியில்தான் கன்னையா கைது செய்யப்பட்டார். கன்னையாவும் அந்தக் கூட்டத்தில் இருந்தார். அந்த தேதிதான் அஃப்சல் குரு தூக்கிலடப்பட்டு இறந்ததின் நினைவு நாள். அவரைப் போற்றும் விதமாக நடந்த கூட்டத்தில் அஃப்சல் குருவின் படங்களும் பிரதானமாகத் தென்பட்டன.   அஃப்சல் குரு பிரிவினைவாதியாக இருந்தவர். பாகிஸ்தான் ஆக்கிரமிப்பு காஷ்மிர் பகுதிக்குச் சென்று அந்த நாட்டு ராணுவத்திடம் பயிற்சி பெற்றவர். பாராளுமன்றத்தைத் தாக்கிய தீவிரவாதிகளுக்கு இந்தியாவில் அடைக்கலம் தந்து அந்தத் தாக்குதலுக்கு துணை போனவர். அந்த வழக்கில் தான் அவருக்கு மரண தண்டனை கிடைத்து நிறைவேற்றப் பட்டது. இப்படித்தான் அஃப்சல் குரு அறியப்பட்டாரே தவிர இந்தியாவில் பசி, ஏழ்மை, ஊழல், ஜாதிப் பிரச்சினை ஆகியவற்றைப் போக்கப் போராடினார், பாடுபட்டார் என்பது கிடையாது. அவரின் நினைவைப் போற்றும் கூட்டத்தில் எழுந்த விடுதலை முழக்கம் எதற்காக என்பதை பின்னர் வேறு எப்படி விளக்கினாலும் எடுபடுமா என்ன?
  
கன்னையா குமார் வலது கம்யுனிஸ்ட் கட்சியை சார்ந்தவர். அது அவர் விருப்பம். பெயிலில் வந்த அவர் ஜே.என்.யு மாணவர்களிடையே பேசியபோது பிரதமருக்கு எதிராக அரசியல் ரீதியில் வார்த்தைகள் விட்டுமிருக்கிறார். அவற்றில் ஒன்று: “இந்தியாவில் 31 சதவிகிதம் பேரின் ஆதரவுதான் உங்களுக்கு உண்டு. 69 சதவிகிதம் உங்களை எதிர்த்து வாக்களித்துள்ளார்கள்” என்று பிரதமரை நோக்கி அவர் சொன்னது. 2014 நாடாளுமன்ற தேர்தலில் 281 சீட்கள் கைப்பற்றி ஆட்சி அமைத்த ஒரு கட்சியின் தலைவரைப் பற்றி ஒரே ஒரு சீட் வெல்ல முடிந்த ஒரு கட்சியின் ஆதரவாளர் பேசுகிற பேச்சு இது! அவர் ஜே..என்.யூ-வில் பயிலும் ஒரு ஆராய்ச்சி மாணவரும் கூட! பிரதமரை எதிர்க்கும் டெல்லி முதல் மந்திரிக்கும் அந்தப் பேச்சு அல்வாவாக இனித்திருக்கும். ஆனந்தப்பட்ட கேஜ்ரிவால் “என்ன பிரமாதமான பேச்சு!” என்று ட்வீட் செய்கிறார். ஜே.என்.யு மாணவர்கள் படிப்பிலிருந்து எவ்வளவு விலகி வந்திருக்கிறார்கள், அரசியல் ஆதாயத்துக்காக சில தலைவர்கள் அந்த இளைஞர்களை எப்படிப் பகடையாக உருட்டிப் பார்க்கிறார்கள் என்பதுதான் இதில் தூக்கி நிற்கும் மிக வருத்தமான விஷயம். 

கன்னையா குமார் மற்றும் சில மாணவர்கள் மீதான தேச விரோத வழக்கை கோர்ட் எப்படிப் பார்த்து முடிவு செய்யப் போகிறது என்பது இப்போது முக்கியமான விஷயமல்ல.  கோர்ட்டின் முடிவு எப்படி இருந்தாலும் இது விஷயமாக சட்டத்தில் இன்னும் தெளிவு ஏற்பட வகை உண்டு.  மத்திய அரசை எதிர்க்கும் ஒரு மாணவர் தலைவர் மீது வேறு எதேனும் அரசியல் சார்ந்த கிரிமினல் வழக்கு எற்பட்டு அவர் பெயிலில் வந்து இருந்தால் – அதுவும் ஜே.என்.யு-வை சேர்ந்தவரானால் – அப்போதும் எதிர்க் கட்சிகள் இதே ஆர்வத்தையும் பாசத்தையும் அந்த மாணவர் தலைவர் பால் காண்பிக்கும்.  அந்த பல்கலைக் கழகத்தில் படிப்பின் முக்கியத்துவம் கண்டிப்பாக பாழ்படும்.

எதோ “சுதந்திரம் சுதந்திரம்” என்று கேட்டு விட்டு இப்போது ”இந்தியாவிலிருந்து அல்ல, இந்தியாவிற்குள் சுதந்திரம் என்றுதான் கேட்டோம்” என்கிறார்கள்.  இது கேசுக்கு உதவுமோ என்னவோ, போகட்டும்.  நல்ல வேளை! “புதிதாக 251 ரூபாய்க்கு வந்திருக்கும் ஃப்ரீடம்-251 எனப்படும் செல்போன்தான் நாங்கள் கேட்ட ஃப்ரீடம்!’ என்று விளக்காமல் விட்டார்களே!

இந்தியாவின் அளவிற்கு சுதந்திரம் கொண்டாடும் அமெரிக்காவிலோ, இங்கிலாந்திலோ கன்னையா குமார் மாதிரி ஒரு மாணவர் தலைவர் “தேவை நாட்டுக்குள் சுதந்திரம்!” என்று கோஷம் எழுப்பினால் மக்கள் சிரிப்பார்கள்.  அதே கோஷத்தை சீனா, பாகிஸ்தான் போன்ற நாடுகளில் ஒருவர் வெளிச் சொன்னால் பின்னர் அவர் அழுவார் – அவர் இருக்கும் வரை.  இந்தியாவில் ஒருவர் அப்படி கோஷம் போட்டால் – அதுவும் ஜெ.என்.யு-வில் போட்டால் – அவர் சிரித்துக் கொண்டு அரசாங்கத்தை அழ வைக்கலாம்; இந்திய பொது மக்கள் சிரித்துக்கொண்டே அழவேண்டும்.

An Open Letter to Justice C. S. Karnan


Dear Hon’ble Justice C. S. Karnan,

I know it, sir.  Writing to a judge on his views expressed in court about a case coming up before him is not good manners. But one may say things to a judge on what he says outside the court on other matters – for example, on music or on the condition of court buildings.

Sir, last week you came out of your hallowed seat of the Madras High Court, addressed press persons at its gates and became the centre of news stories across India. They made a sad reading, particularly your accusations against your brother judges, the Chief Justice of the High Court, the Chief Justice of India and some judges of the Supreme Court. I wish to say a few things, in grief and in goodwill. I would just touch upon a thing or two from what you spoke.  What I say here is relevant, though not central to what you were announcing that day.

       By now everyone knows you are a member of the Scheduled Castes, as you said to newsmen.  A lawyer arguing before your court or his client in the case would not be concerned about that fact.  The reason is simple.  The most important thing for any such lawyer or client in any court is this: he should get a judgement that pleases him. If a litigant’s case has merits and he gets a final judgement favouring him the winning party and his lawyer will admire the judge, but the losing party, or at least his lawyer who should know better, will also have respect for the judge for a fair judgement.  So a good judge – man or woman, of any religion or caste, of any region in India – is really liked by lawyers who are active in the courts.  That way, a judge is perhaps better placed than the holder of a political office like a minister in government.  A minister may have opponents, from his own caste or from any other, from his own party or from the Opposition, constantly scheming and trying to pull him down.  A judge, especially a High Court judge, cannot be ousted easily and he has only to deal with lawyers who appear before him – and not battle with opponents trying to trip him or see him out of office.  A judge is less hamstrung in his work by his religious, regional or caste backgrounds.

     So lawyers doing their cases in a court, especially a High Court, cannot have antipathy towards a good judge, whatever his background.  Since their work in courts brings them their daily bread they cannot feel otherwise – except for those not serious with their work or not seen much inside court rooms.  Like, for example, when I buy apples I would get good ones from a seller, whoever he is, rather than go for bad ones from a seller who belongs to my caste. Also, why have the founders of Microsoft and Google, who are Americans, employed Indians – Satya Nadella and Sundar Pichai – rather than Americans as chief executive officers in the US?  Because those businessmen feel that, at this time, their Indian officers would deliver best.  Lawyers who contest cases in courts think likewise, expecting results from judges hearing and deciding their cases.

     Those who fight predominantly about race, religion, gender or caste of a judge, pushing merit and good work in the background, are politicians who look for votes in a bickering about those issues.   But lawyers and clients concerned with cases in courts would care less about those things as they look for good judgements.  It is essential to see this difference – and to keep polluting effects of politics away from campuses of law colleges and law courts.

      Yes, sir.  Caste exists for real in Hindu society, with its wide baneful fallout on public life.  Solutions have to come from within that society, not outside. If at all we can solve them little by little, people should first see examples in the conduct of men and women at the top in many places, who talk less about caste differences, ignore some irritants here and there and go about their work gently with a smile – that is an art like writing a judgement. 

      Sir, there is yet another side.  When one parent seriously faults and fights with another in front of their children, the children feel left out and distressed.  That is how the lawyer community should feel today.  I think every parent must take care.

Electing Women to Panchayats – 50% Reservation is 100% Farce

This is recent news – the central government will take steps to amend the Constitution to increase reservation of seats for women in elections to panchayat bodies from the present 33% to 50%.  Who benefits if that happens?  Not anyone.

Compulsory reservation for women among elected members and Chairpersons of panchayat bodies has been followed in several states of India – for twenty years in some, and less in others. The Indian Constitution mandates it, since 1993, at a minimum of 33% of contested seats.  A proposal to hike it to 50% was approved by the Union cabinet of an earlier government in 2009, but the Constitution is yet to be amended for the purpose.  A different ruling party now running the central government cannot drop that idea and invite political peril.   

But we should ask : Can we believe that the existing 33% reservation has toned up governance at village levels and enhanced women’s prestige in village areas, and so making it 50% will brighten such results even more? Or have we found that a mere 33% is not enough to get expected benefits and that a minimum 50% reservation is needed?  “No. None of it” should be our answer to both questions.

More than women, men desire, grab and enjoy power in politics.  Males are one half of our population, and more than half among elected representatives in our legislatures.  Without their approval the present 33% reservation would not have happened, nor can it go up.   That is not because our male politicians are generous and sacrificing.  It simply points to a ground reality – this reservation serves as a cloak for clever men to project their obedient wives, mothers or daughters as contestants for reserved seats in panchayat polls, secure their election and rule by proxy.  Those women know this and are happy to help their men folk by just being name-lenders.  And all – including government officials supervising local administration - who deal with or pay purposeful respect to those controlling men behind the mute elected women in panchayats know this.  This is a great farce in our politics and government.

Yes, there is a question to be answered. What is wrong in husbands, fathers or sons helping out women in their families when the law requires that women alone can contest some panchayat seats?  Two counter questions get us the answer.  When women in panchayat areas are not so elected, in what ways and for how long are they helped by men in their homes?  Will a straight-thinking man who respects his wife, daughter or mother, consent to proxy for her illegally in government work, and do the things done by a good number of 33% or 50% male proxies?

Let me not leave out this question.  Why should anyone – here a woman – agree to hold an elected office but let her official power and add-ons lie in the hands of another person – here a man?  Man or woman, if one is dependent on another in many ways or if one is indebted to another for reasons they know best, this fronting or proxying in varying extent could happen anywhere.  If the names of Lalu Prasad Yadav and Rabri Devi, or Sonia Gandhi and Manmohan Singh, suddenly cross your mind now you will have some good reason.

Compulsory reservation for women in panchayat bodies, and the way it is worked, do not really help women among the public.  Women everywhere look for their physical safety and security foremost, and if their elected representatives can ensure that while they govern, women would be glad and relieved even if all or a vast majority of those representatives are men.  But if they have to live amidst an unsure sense of safety and security, holding and concealing their fright, it makes no difference to them that 33% or 50% of their elected representatives are also women.  Horror stories in newspapers every other day about unfortunate female victims tell us how insecure Indian women feel on our soil.

Women voters are not really yearning for reservation in panchayat positions.  If they really do, they can act in unison and elect a female candidate pitted against male candidates from an unreserved constituency. That would surely happen if they wish it since they make up about 50% of voters.  Just as, in a free-for-all election, a candidate of the same caste as a good chunk of the voters in his constituency wins.  Then why do our dominant male politicians play out this farce?  Perhaps they think they are placating women voters by this false concession.  And perhaps women voters feel that if it pleases men on their pet political pranks let it be – why raise questions, dissatisfy ambitious political men and possibly have a dent in women’s overall sense of safety and security, whatever it be?  Indian men who pioneered and backed this reservation have failed our women by making puppets out of the latter and degrading their dignity in a public sphere. 

Want some more proof that our male politicians are cooking up this farce of espousing women’s cause? Well, if men truly believe that more of women should be elected to political offices – as high as 33% or 50% - and make decisions to run governments, men would have first asked women to take up top posts within their political parties at village level or district level everywhere.  Men don’t do it because they wish to be widely in charge of party affairs (rightly, as they fit those roles better), but when it comes to elected political offices in government they make it appear they would let women fill up those offices  – 33% or 50% of them – while they still run those offices from behind.

We have also powerful examples to prove that men and women do not bother much if their elected rulers are men or women.  We had Indira Gandhi as prime minister, she and her party were defeated massively throughout the country in elections held after she lifted her Emergency, but later she was also voted back to power – without reservation of any kind for women.  Now Jayalalithaa of Tamil Nadu in the South, Mamata Banerjee of West Bengal in the East, Anandiben Patel of Gujarat in the West rule their states as chief ministers.  And in the North, Mehbooba Mufti Sayeed of Jammu and Kashmir could get sworn in as chief minister if she just wants it.  This is the spectacle in the four corners of India with no reservation helping these four women – and men voters in huge numbers in the four states wanting them at the helm.  Likewise, male chief ministers presently ruling in other states enjoy the support of women voters in large numbers and those voters are not longing for woman chief ministers. It is again clear that 33% reservation is a plain farce, and any increase of it will heighten its effect.  Sadly, it has been elevated as a Constitutional compulsion – not only for panchayats but for municipalities too, and the farce gets enacted in more theatres than one.

If women are inclined to politics and have the guts for it they would come out on their own, lead and shine, like they do now in the four corner states of India. On that some may take inspiration from their fathers or spouses, which is understandable as it happens with all, man or woman.  At national levels too, apart from India's Indira Gandhi, Srimavo Bandaranaike in Sri Lanka, Golda Meir in Israel, Margaret Thatcher in the UK and recently Angela Merkel in Germany rose to head governments on their own strength and leadership qualities – that is natural and welcome in a democracy.  But to stipulate that some electoral constituencies across India at village or municipal levels  - or  in the Lok Sabha and state legislatures - shall only have women candidates (or only men, if law says it), that too at high percentages of 33 or 50 is no good, and in any case an overdose that maims or kills.  This enforced reservation leads to several ills and it would be difficult to remove them as they get entrenched.  And it will have a sinister side effect too – of creating a needless men-versus-women issue and all the acrimony that comes with it.

So, as an Indian, if you object to a good slice of our elected political offices being reserved for women, it doesn’t mean you have malice toward the reservees.  It means you love your homeland.
